1. Scope & Agreement

These Terms of Service (“Terms”) govern your use of the GenCheckup website (beauty-gencheckup.com), products, and services operated by Carole Holzhäuer (“GenCheckup”, “we”, “us”). By accessing our website or purchasing our products, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use our services.

2. Products & Services

2.1 DNA Testing Kits

Our DNA testing kits provide genetic analysis for informational and wellness purposes. Results are based on current scientific understanding and should not be considered medical diagnoses. Always consult a qualified healthcare professional before making medical decisions based on genetic information.

2.2 Personalized Supplements (Pod System)

Our supplement pods are formulated based on your genetic analysis results. Supplements are classified as food supplements under EU Regulation (EC) No 178/2002 and are not intended to diagnose, treat, cure, or prevent any disease.

2.3 Digital Services

Access to DNA reports, the Carole AI Suggest Bot, and wellness course content is provided as part of your purchased kit package. Digital content access begins upon delivery of your DNA report.

3. Orders & Pricing

3.1 Order Process

All orders are subject to acceptance by GenCheckup. We reserve the right to refuse or cancel orders for any reason, including pricing errors, product availability, or suspected fraud. You will be notified promptly if your order cannot be fulfilled.

3.2 Pricing

All prices displayed on our website include applicable VAT unless stated otherwise. Prices are listed in Euros (EUR). We reserve the right to adjust pricing at any time; changes do not affect orders already placed.

3.3 Payment

Payment is processed securely via Stripe at the time of purchase. We accept major credit and debit cards. Subscription payments are automatically charged at the beginning of each billing cycle.

4. Shipping & Delivery

• EU shipping: Free standard shipping within the European Union. Delivery typically takes 5-10 business days.
• International shipping: Available at additional cost. Delivery times vary by destination (typically 10-20 business days).
• DNA kit return shipping: Prepaid return packaging is included with your DNA kit for sending your sample to our laboratory.

Risk of loss passes to you upon delivery. If a package is lost or damaged in transit, contact us within 14 days of expected delivery.

5. DNA Sample & Processing

• You must be at least 18 years old to order and submit a DNA test.
• The DNA sample must be collected by the person whose genetics will be analyzed.
• Results are typically available within 3-4 weeks after the laboratory receives your sample.
• In rare cases, a sample may be insufficient for analysis. If this occurs, we will provide a replacement kit at no additional cost.

6. Subscriptions

6.1 Subscription Terms

Supplement subscriptions are billed at the interval specified at the time of purchase (monthly, quarterly). Subscriptions automatically renew until cancelled.

6.2 Cancellation

You may cancel your subscription at any time through your account dashboard or by contacting us. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.

6.3 Pausing

Subscriptions can be paused for up to 3 months. During a pause, no charges are incurred and no shipments are sent. Subscriptions automatically resume after the pause period.

7. Right of Withdrawal (EU Consumers)

Under EU consumer law (Directive 2011/83/EU), you have a 14-day right of withdrawal from the date you receive your order. To exercise this right, contact us with a clear statement of your decision to withdraw.

Exceptions: The right of withdrawal does not apply to:

• DNA kits once the sample has been submitted to the laboratory (sealed goods not suitable for return due to health/hygiene reasons)
• Personalized supplement pods that have been manufactured to your specification
• Digital content (reports, courses) once delivery has begun with your consent

8. Refund Policy

We offer a 30-day satisfaction guarantee on all DNA kit products. If you are not satisfied with your DNA analysis results, contact us within 30 days of receiving your report for a full refund of the DNA kit component. Supplement costs for already-delivered pods are non-refundable.

9. Intellectual Property

All content on our website — including text, designs, logos, images, reports, and software — is the property of GenCheckup and protected by copyright and trademark law. Your DNA report is licensed for your personal, non-commercial use only. You may not reproduce, distribute, or commercially exploit any content without our prior written consent.

10. Limitation of Liability

To the maximum extent permitted by law:

• Our services are provided “as is” without warranties of any kind regarding the accuracy or completeness of genetic analysis.
• GenCheckup is not liable for any indirect, incidental, or consequential damages arising from the use of our products or services.
• Our total liability for any claim shall not exceed the amount you paid for the specific product or service giving rise to the claim.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under applicable law.

11. Governing Law & Disputes

These Terms are governed by the laws of the Federal Republic of Germany. For consumers residing in the EU, mandatory consumer protection laws of your country of residence also apply. Any disputes shall be resolved in the courts of Germany, unless mandatory consumer law provides otherwise.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or website notice at least 30 days before taking effect. Continued use of our services after changes constitutes acceptance of the revised Terms.
